Terms of Service

These terms govern your use of Mealyo, a project of Enactus Mannheim e. V.

Note: Mealyo is a project of the non-profit association Enactus Mannheim e. V. Full provider details are in the Imprint. The legally binding version of these terms is the German one; this English text is provided for convenience.

§ 1 Scope

(1) These Terms of Service ("Terms") govern the use of Mealyo on the website mealyo.de and in the Mealyo app for iOS and Android. They apply whether use is free or paid.

(2) Only these Terms in their version applicable at the time of use govern the relationship between Enactus Mannheim e. V. ("Mealyo") and the user. Deviating terms are not accepted unless we expressly agree.

§ 2 Service description

(1) Mealyo is a digital kitchen assistant that helps you reduce food waste, organise your pantry, build shopping lists and weekly plans, and manage recipes. Some features rely on artificial intelligence (see § 5).

(2) We may continuously develop the service, add, change or discontinue features. We will notify you at least 30 days before material changes to paid features take effect.

§ 3 Use of the service

(1) Mealyo can be used for free or under paid subscriptions. Paid use always requires your separate, explicit consent.

(2) By using the website or installing the app you agree to these Terms. If you download the app via an app store, its terms apply in addition.

(3) You confirm that all information you provide is accurate and up to date, and you must protect your account against unauthorised access. Suspicious activity must be reported to team@mealyo.de without delay.

(4) You must not abuse the service, circumvent technical protections or use it in a way that harms us, other users or third parties.

(5) We may temporarily suspend or close accounts that violate these Terms.

§ 4 Minimum age

You must be at least 16 to use Mealyo. If you are younger, you may only use Mealyo with your parent or guardian's consent.

§ 5 Use of artificial intelligence

(1) Mealyo uses AI models to power features such as receipt parsing, translations, recipe and weekly-plan suggestions, and structuring your input.

(2) AI-generated content (recipe suggestions, allergen or nutrition notes, etc.) is created using current technology. We make no guarantee as to its accuracy, completeness or suitability in a specific case. AI content may be wrong or incomplete ("hallucinations") and does not replace medical or nutritional advice.

(3) You are responsible for checking AI-generated information for plausibility before relying on it — especially in case of allergies, intolerances, pregnancy, illness or special diets.

(4) You may not use the AI features to train your own machine learning models or reverse engineer the underlying technology.

§ 6 Health disclaimer

Mealyo is not a medical device. Recommendations, tips, nutritional calculations and AI suggestions are not medical, nutritional or therapeutic advice. If you are under medical care or have special dietary needs, consult a doctor before changing your diet. We accept no responsibility for health consequences arising from your use of the service.

§ 7 Term and cancellation of free services

Free use of Mealyo can be terminated at any time by deleting your account in the app settings or by emailing team@mealyo.de.

§ 8 Paid subscriptions

(1) Mealyo offers paid subscriptions of different lengths ("Mealyo Pro" and "Mealyo Family"), purchased via the Apple App Store or Google Play. Billing is governed by the respective store's terms.

(2) Mealyo may offer free trial subscriptions. If you do not cancel within the trial period, the trial automatically converts into a paid subscription. You will be informed of this before the trial starts.

(3) Subscriptions automatically renew at the original price unless cancelled before the end of the term. Cancellation happens via the subscription settings of the respective store.

(4) Unless required by mandatory law, we do not refund unused portions of a subscription period.

(5) Consumers may withdraw from a paid subscription under their statutory right of withdrawal — see Right of withdrawal.

§ 9 Availability

We aim for high availability but cannot guarantee uninterrupted service. Maintenance windows, technical issues or outages of third-party providers (e.g. Google Cloud, app stores) may cause temporary limitations.

§ 10 Liability

(1) We are liable without limitation for intent and gross negligence and for damages to life, body or health.

(2) For slightly negligent breaches of essential contractual duties ("cardinal duties"), our liability is limited to typical, foreseeable damages. Otherwise, liability for slight negligence is excluded.

(3) We are not liable for damages resulting from your reliance on AI-generated content where the inaccuracy was reasonably recognisable on inspection.

(4) Liability under the German Product Liability Act remains unaffected.

§ 11 Changes to these Terms

We may change these Terms when needed to adapt to changes in the law, technical developments or new features. We will give at least 30 days' notice of material changes via email or in the app. If you do not object within that period, the changes are deemed accepted.

§ 12 EU online dispute resolution

The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 13 Final provisions

(1) These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection law of the country where you usually live remains unaffected.

(2) If individual provisions are or become invalid, the validity of the remaining provisions is unaffected.

(3) These Terms are provided in German and English. The German version is binding; in case of contradictions, the German version prevails.
